1.1 These Terms and Conditions govern the sale of products offered by Eighteen & Beyond (“we”, “our”, or “us”) via their website (“Website”) and apply to all purchases made by consumers and customers through the Website.

1.2 By placing an order, you confirm that you have read, understood, and accepted these Terms and Conditions.

3. Products

3.1 Eighteen & Beyond offers golf apparel, accessories, and related products for sale online.

3.2 We make reasonable efforts to ensure that product descriptions, images, colours, specifications, and prices are accurate. However for the avoidance of doubt:

1. Colours may vary depending on device settings and screen displays.
2. Product images are for illustrative purposes only.
3. Minor variations in design, packaging, or manufacture may occur.

3.3 Possible inaccuracies can occur at the moment of placing your order. Subject to applicable law, we do not accept any liability for these inaccuracies.

3.4 We retain the right to change, add and delete information on our website at any time without prior notice being required.

4. Orders

4.1 You can order products on our website by selecting them and placing them in your shopping cart. You can check the content of your cart before proceeding with your order. In your shopping cart, you can make any adjustments to your order. You should receive an acknowledgement email confirming receipt of your order.

4.2 An acknowledgement email does not constitute acceptance of the order.

4.3 Products in your cart are not reserved for you until the order process is fully completed.

4.4 A contract for sale is formed only when the order has been accepted and dispatched by Eighteen & Beyond.

The actions to be taken and when they should be taken are at our sole discretion.

5. Pricing and Taxes

5.1 All prices displayed on the Website are shown in Euros (€) and include applicable VAT unless otherwise stated.

5.2 Shipping charges are calculated and displayed separately during the checkout process.

5.3 Prices may be changed at any time before an order is confirmed. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced on the website. The prices as displayed in your shopping cart are the check-out price. Subject to applicable law, we are not liable for or bound to prices that are evidently incorrect or erroneous.

5.4 If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may:

6.2 All payments are processed through secure third-party payment providers.

6.3 Eighteen & Beyond does not store complete payment card details.

6.4 Orders will not be processed until payment has been successfully authorised. Your credit card will be charged upon Order Confirmation.

7. Shipping and Delivery

7.1 We deliver to the destinations listed on the Website.

7.2 Estimated delivery times are provided for guidance only and are not guaranteed.

7.3 Delivery delays may occur due to:

1. Carrier delays
2. Customs procedures
3. Severe weather
4. Public holidays
5. Circumstances beyond our reasonable control

7.4 Customers are responsible for ensuring that delivery information is accurate.

7.5 Additional customs duties, taxes, or import charges for deliveries outside the European Union are the responsibility of the customer.

7.6 Risk in the products passes to the customer upon delivery.

8. Right of Withdrawal

8.1 Consumers have the right to withdraw from a purchase within thirty (30) calendar days from the date on which the goods are received, without providing any reason.

8.2 To exercise this right, customers must notify Eighteen & Beyond by email before the withdrawal period expires.

8.3 Products must be returned:

1. Unworn;
2. Unused;
3. In original condition;
4. With tags attached; and
5. In original packaging where reasonably possible.

8.4 Customers are responsible for return shipping costs unless otherwise stated.

8.5 Refunds will be processed within fourteen (14) days of receiving the returned products or satisfactory proof of return.

8.6 Refunds will be issued using the original payment method.

8.7 You may end the contract in situations where we inform you that we are not able to do what we told you we were going to do, such as:

1. we have told you about an upcoming change to the product or these terms which you do not agree to;
2. we have told you about an error in the price or description of the product you have ordered, and you do not wish to proceed;
3. there is a risk that supply of the products may be significantly delayed because of events outside our control; or
4. we have suspended supply of the products for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for a period of more than 14 days.

8.8 If you are ending a contract for a reason set out at under clause 8.7 (a) to (d) above, the contract will end immediately and we may refund you in full for any products which have not been provided.

9. Returns and Exchanges

9.1 In addition to statutory rights, you may, where a return request has been accepted by Eighteen & Beyond, be able to return such product(s) and get a refund if you are within the 30 day return policy period, which shall start on the date you have received the product(s).

9.2 Products returned in unsuitable condition may be refused.

9.3 In the event you have received a promotional gift with your order and you want to return the full order to us, please make sure to include the gift with your return shipment. Should you keep the gift, we will deduct the price of the gift from your refund.

9.4 After the receipt of your return order, we will make any refunds due to you as soon as possible, and within a maximum of 14 days after we received the returned goods.

10. Defective or Incorrect Products

10.1 If a product is:

1. Defective;
2. Damaged upon delivery; or
3. Incorrectly supplied

Customers should contact us promptly.

10.3 Where appropriate, remedies may include:

2. Price reduction; or
3. Refund.

11.3 If an order can no longer be fulfilled due to circumstances beyond our control (force majeure), such as errors in availability and/or delivery, we will inform you of this within a maximum of fourteen (14) days after the date of your order and we may end the contract. We will provide you with a refund for any sums you have paid in advance for products which can no longer be provided to you.

12.1 Promotional offers and discount codes:

1. Cannot be exchanged for cash;
2. May not be combined unless expressly stated;
3. May be withdrawn or amended at any time;

13. Intellectual Property

13.1 All intellectual property rights relating to:

2. Product photography;
3. Logos;
4. Branding;
5. Product descriptions and copy;

remain the property of Eighteen & Beyond and/or its licensors and shall not be used or duplicated in any way, unless for personal use or express permission has been granted by Eighteen & Beyond.

13.2 No content may be reproduced without prior written permission.

14. Limitation of Liability

14.1 Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

14.2 Subject to this, Eighteen & Beyond shall not be liable for:

1. Indirect losses
2. Consequential losses
3. Loss of profits
4. Business interruption
5. Delays caused by third parties

14.3 Our total liability shall not exceed the purchase price of the products concerned.

16. Governing Law

These Terms and Conditions are governed by the laws of Spain.

17. Jurisdiction

Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of Spain, without prejudice to mandatory consumer rights applicable in the customer’s country of residence.
